Terms and Conditions

Welcome to Alian Hub, a project management software-as-a-service (SaaS) platform operated by Alian Software (“we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of Alian Hub, available at https://app.alianhub.com/ (the “Service”), including all features such as project management, HR management, time tracking, workload management, real-time chat, and integrations. By accessing or using the Service, you (“you” or “User”) agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Acceptance of Terms

By creating an account, accessing, or using the Service, you confirm that you are at least 16 years old, have the legal capacity to enter into these Terms, and agree to comply with these Terms and all applicable laws. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Account Registration and Use

a. Account Creation

To use the Service, you must create an account by providing accurate and complete information, including your name, email address, and company name. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

b. Account Responsibilities

  • You agree to notify us immediately at support@aliansoftware.net if you suspect unauthorized use of your account.
  • You are responsible for ensuring that your use of the Service complies with these Terms and applicable laws.
  • You may invite team members to collaborate within your account, and you are responsible for their compliance with these Terms.

c. Account Termination

We reserve the right to suspend or terminate your account at our discretion, including for violations of these Terms, non-payment, or suspected fraudulent activity.

3. Subscriptions and Payments

a. Subscription Plans

Alian Hub offers free and paid subscription plans. Paid plans provide access to additional features, such as advanced permissions, integrations, or increased storage. Details of subscription plans are available at https://app.alianhub.com/.

b. Payment Terms

  • Payments for paid plans are processed through third-party payment processors. You agree to provide accurate payment information and authorize us to charge your chosen payment method for the applicable fees.
  • All fees are non-refundable unless otherwise stated or required by law.
  • We may adjust subscription fees at any time, with notice provided via email or through the Service. Continued use of the Service after a fee change constitutes acceptance of the new fees.

c. Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to the Service until the end of the current billing period, after which your account will revert to a free plan or be deactivated if no free plan is available.

4. Referral Program

a. Eligibility and Participation

Alian Hub offers a referral program allowing users to earn commissions by referring new users to the Service. During account and company creation, you may enter a referral code provided by another user. Referral codes cannot be added or modified after the company is created.

b. Referral Commission

If you refer a new user who purchases a paid subscription plan using your referral code, you will receive a commission, currently set at 10% of the referred user’s paid subscription fees, though this percentage is subject to change at Alian Software’s sole discretion. This commission is awarded for the lifetime of the referred user’s active billing cycle, provided both your account and the referred user’s account remain active and in good standing. Any changes to the commission percentage will be communicated via email or through the Service.

c. Use of Commission

  • Commissions earned through the referral program can only be applied as a credit toward your next subscription plan purchase with Alian Hub.
  • Commissions are non-transferable and cannot be withdrawn as cash or used for any purpose other than offsetting subscription fees.
  • If your account is terminated or you cancel your subscription, any unused commission credits will be forfeited.

d. Program Restrictions

  • You may not use deceptive or unethical methods to obtain referrals, such as spamming or misrepresenting the Service.
  • We reserve the right to disqualify referrals or commissions if we suspect fraudulent activity, abuse, or violation of these Terms.
  • We may modify or terminate the referral program at any time, with notice provided via email or through the Service. Any earned commissions will remain valid for use toward your next plan purchase, subject to these Terms.

5. Use of the Service

a. Permitted Use

You may use the Service for lawful purposes related to project management, collaboration, and other features provided by Alian Hub. You agree to use the Service in accordance with these Terms and any documentation provided.

b. Prohibited Activities

You may not:

  • Use the Service to store or transmit illegal, harmful, or infringing content.
  • Attempt to gain unauthorized access to the Service or its systems.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Use the Service to send spam, phishing messages, or other unsolicited communications.
  • Interfere with or disrupt the Service, including by introducing viruses or malicious code.
  • Use automated tools (e.g., bots or scrapers) to access or extract data from the Service without our permission.

c. User Content

  • You retain ownership of any data, files, or content you upload to the Service (“User Content”). By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display such content as necessary to provide the Service.
  • You are responsible for ensuring that your User Content does not violate these Terms or infringe on third-party rights.

6. Intellectual Property

a. Our Intellectual Property

The Service, including its software, design, trademarks, and content (excluding User Content), is owned by Alian Software or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our written permission.

b. Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, royalty-free right to use and incorporate such feedback without any obligation to you.

7. Third-Party Integrations

The Service may integrate with third-party tools (e.g., Wasabi for storage, Firebase for notifications). Your use of these integrations is subject to the respective third-party terms and policies. We are not responsible for the performance or security of third-party services.

8. Privacy

Your use of the Service is subject to our Privacy Policy, available at https://app.alianhub.com/, which explains how we collect, use, and protect your personal information.

9. Termination

a. By You

You may stop using the Service and delete your account at any time. Deleting your account may result in the permanent loss of your User Content, subject to our data retention policies.

b. By Us

We may suspend or terminate your access to the Service if you violate these Terms, fail to pay applicable fees, or if we discontinue the Service. We will notify you of such actions where feasible.

c. Effect of Termination

Upon termination, you must cease using the Service, and any outstanding fees remain due. Provisions of these Terms that by their nature should survive termination (e.g., intellectual property, liability) will continue to apply.

10. Disclaimers and Limitation of Liability

a. Disclaimers

  • The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • We do not guarantee that the Service will be uninterrupted, error-free, or secure, or that it will meet your specific requirements.

b. Limitation of Liability

To the maximum extent permitted by law, Alian Software, its affiliates, and their respective officers, directors, and employees will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including loss of data, profits, or business opportunities. Our total liability for any claim will not exceed the amount you paid for the Service in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Alian Software, its affiliates, and their respective officers, directors, and employees from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your use of the Service, your User Content, or your violation of these Terms.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of India, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Service will be resolved through binding arbitration in Anand, Gujarat, India, in accordance with the rules of the Indian Arbitration and Conciliation Act, 1996. You waive any right to participate in a class action lawsuit against us.

13. Changes to These Terms

We may update these Terms to reflect changes in our practices or legal requirements. We will notify you of significant changes via email or through the Service. Your continued use of the Service after such changes constitutes acceptance of the updated Terms. The “Last Updated” date at the top indicates the latest version.
